1. Agreement to Terms

By accessing atss.pro or using any Apex AI service, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

Apex AI provides AI-powered business automation services including, but not limited to, lead capture, automated follow-up, appointment setting, and AI voice agents. Service scope is defined in your individual service agreement or subscription plan.

3. Payment Terms

Monthly subscription fees are billed in advance and are non-refundable unless otherwise stated
One-time setup fees are due prior to onboarding and are non-refundable
Failure to pay may result in suspension or termination of services

4. Cancellation

You may cancel your subscription at any time with 30 days written notice to info@atss.pro. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.

5. Client Responsibilities

You agree to:

Provide accurate and complete information required to deliver services
Comply with all applicable laws, including those governing electronic communications and telemarketing
Not use our services for any unlawful, harmful, or deceptive purpose

6. Intellectual Property

All content, branding, workflows, and technology provided by Apex AI remain the intellectual property of Apextech Software Systems LLC. Custom deliverables built for your business become your property upon full payment.

7. Limitation of Liability

Apex AI is not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability is limited to the fees paid by you in the 30 days preceding the claim.

8. Disclaimer of Warranties

Services are provided "as is" without warranties of any kind. We do not guarantee specific results, including revenue increases, lead volume, or booking rates.

9. Governing Law

These terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the courts of Camden County, New Jersey.

10. Changes to Terms

We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
